This is an appeal from a judgment of conviction and sentence of the defendant-appellant, Gary L. Emch, by the Municipal Court of Findlay for the offense of driving under the influence of alcohol. The defendant, in the court below, filed a motion to suppress the results of an intoxilyzer test given to him at the time of his arrest. When the motion was overruled by the trial court, the defendant changed his plea from not guilty to no contest, and was found guilty and sentenced.
