(1) The information in this case does not charge that the defendant “made an assault” or “did make ■an assault” and the information is insufficient. Sec, 4530, R. S. 1909; State v. Calbert, 209 Mo. 280. (2) John Cidius was the main star witness ,for the State, not jointly indicted with the defendant, hut under an indictment for the same offense, and the court, over defendant’s objections, permitted the introduction of the information against Citius, the State’s own witness, and' this was prejudicial error to the defendant.…

On the 26th day of March, 1917, the prosecuting attorney of Pemiscot County filed in the circuit court of that county his duly verified information charging defendant herein with the crime of robbery in the first degree. Upon his trial defendant was found guilty and his punishment assessed at imprisonment in the Penitentiary for a term of five years. Prom the resulting sentence .defendant has appealed.
