This proceeding was instituted by David Dixon Russell for the purpose of obtaining the custody of his infant son who had been turned over to Mr. and Mrs. Burton by its mother. The son is now seven years old, but at the time of this proceeding was six years of age. The court granted *341the prayer of the habeas corpus petition and awarded the custody of the said infant to his father, and Mr. and Mrs* Burton obtained the present writ of error.
