Ledbetter, Receiver v. Sanford

Supreme Court of Arkansas

1Opinion of the Court

Ed. F. McFaddin, Justice.

This appeal must be decided on the issue of venue, thus leaving entirely undecided the question of liability.

On January 7, 1946, appellee Sanford received injuries while employed by appellant railway company, and he brought this action under the Federal Employers’ Liability Act (IT. S. C. A. Title 45, § 51, et seq.). The injury occurred in Hempstead county, Arkansas, of which county Sanford was a resident at the time of the injury. He brought this action in Pike county; and appellant duly and seasonably objected to the venue, and presents that issue in this court.
