*987In an action to foreclose a mortgage, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Mayer, J.), dated March 13, 2009, as granted those branches of the motion of the defendant Terence Thomas which were for leave to amend his answer to assert the defenses of lack of standing and lack of capacity to sue, and to assert violations of article 12-D of the Banking Law, violations of the Real Estate Settlement and Procedures Act (12 USC § 2604 [c]), and violations of the Truth in Lending Act (15 USC § 1601 et seq.).
