The plaintiff brought an action of debt in 'the circuit court of Wood county, against William H. More-head and James N. Wilkins, to recover the amount of a supposed negotiable note, executed by the said Morehead to the said Wilkins, and by him endorsed to the plaintiff. Neither party requiring a jury to try the issues in the cause, the court in lieu of a jury, heard the evidence and rendered a judgment for the plaintiff against Morehead, for the amount claimed in the declaration, Wilkins not being before the court.
