C. S. Swiney and Mario Moscardelli filed their petition for injunction against the City of Forest Park and its mayor and councilmen, alleging that the plaintiffs were residents of and property owners in a territory which was not included within the corporate limits of the city before the passage and approval of an act of the General Assembly of the State of Georgia passed at the 1953 Nov.-Dee. session thereof (Ga. L. 1953, Nov.-Dee. Sess., p. 3029 et seq.); and that this act enlarged the city limits so as to include the lands and homes of petitioners and make them liable for…
