Trespass on the Case for negligence.

This cause is before the court upon a motion to dismiss, for lack of jurisdiction, made upon a special appearance entered by the defendant for this purpose only. The motion came before the Superior Court for hearing, and, as in the opinion of that court the questions of law arising on the motion were of such doubt and importance and so affected the merits of the controversy that they ought to be determined by the Supreme Court before further proceeding, the questions arising upon this motion were certified to this court under the provisions of section 478 of the Court and Practice Act.
