This suit was instituted in the district court of Lubbock county, Tex., .by appellant, W. A. Bounds, against the ap-pellee, the Home Mutual Life & Accident Association No. 1, of Lubbock, Tex.
Appellant alleged that on March 12, 1923, the appellee executed and delivered to his wife, Claudia Bounds, a policy or certificate of insurance in which he was named beneficiary, insuring the life of his said, wife for the maximum sum of §1,000, and thereby became liable on her death to pay him said sum; that his wife died February 14, 1925, up to which time all. premiums and assessments due on the policy…
