LESTER, Judge.

This is an appeal from a judgment entered upon a jury verdict awarding appellee compensatory and punitive damages for timber cut by appellants.

Appellant, C.P. Gum, owned a ninety-two-acre tract of land bordering a fifty-acre tract owned by appellee, Clarence Coyle. *930Adjacent to both of these is yet a third parcel owned by one Archie Kimball who is neither a party to this action nor did he appear as a witness.
