The subject matter of controversy in the suit between these parties is certain real estate in the city of St. Louis, to which the *435plaintiff below claimed title as purchaser at a sale made by the assignees of Cochran & Pollack, and also by deed from Cochran himself.* The defendants set up a title to the property under proceedings in attachment commenced subsequent to the execution and recording of the deed of assignment.
