HANNA, Judge.

William Brandecker, the personal representative for the estate of Mrs. Clarisse Dean, filed a discovery of assets suit and named as defendants the beneficiaries of Mrs. Dean’s will and trust. Mr. Brandecker’s suit pleaded actions for discovery of assets, declaratory judgment, establishment of a constructive trust, and an accounting. The defendants are four great-nieces and nephews of Mrs. Dean. The defendants pleaded the affirmative defense that Mrs. Dean lacked the mental capacity to revoke her trust agreement.
