HALL, Chief Justice.
The agreed statement of the case is as follows: The appellant filed in the trial court petition praying for a divorce from appellee, for a division of property, and for custody of their two minor children, Virginia Rose, a girl, age 10, and Lonnie Albert, a boy, age six. Upon trial the divorce was granted appellant and the property divided. No appeal was taken from that judgment. The custody of both minor children was awarded to the appellee, Lonnie Avener Beadles, from June 1st to September 1st, of each year, subject to appellant’s right to have said children with her one…
