The appellee, The American Surety Company, of New York, instituted this suit in the circuit court of the second judicial district of Bolivar county. against the appellant, Sol Seelbinder, to recover a sum alleged to have been paid by the appellee to the Jefferson Standard Life Insurance Company, as required under an indemnity bond executed by the appellant in favor of said life insurance company with appellee as surety.
