In an action for an accounting *596and a declaratory judgment that the plaintiff is the owner of 1% of the common stock of the defendant BMW (N) Holding Corp., the plaintiff appeals from an order of the Supreme Court, Nassau County (Christ, J.), dated December 20, 1991, which granted the defendants’ motion for summary judgment.
Ordered that the order is affirmed, with costs, and the matter is remitted to the Supreme Court, Nassau County, for entry of a judgment declaring that the plaintiff is not the owner of 1% of the common stock of the defendant BMW (N) Holding Corp.
