— Appeal by the defendant from a judgment of the Supreme Court, Rockland County (Nelson, J.), rendered June 20, 1989, convicting him of rape in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

The evidence adduced at the hearing demonstrated that the police approached the defendant as he was playing basketball at a high school gymnasium. Stating that they wanted to speak to him for a moment, the officers called the defendant to the sideline.
