In a medical and chiropractic malpractice action, the defendant third-party plaintiff appeals from an order of the Supreme Court, Nassau County (Lockman, J.), dated May 19,1980, which granted the motion of the third-party defendant to dismiss the third-party complaint. Order reversed, with $50 costs and disbursements, and motion to dismiss the third-party complaint denied. The main action sounds in malpractice. The neck and skull of Louis Getzelman (hereafter plaintiff) were injured in a surfing accident. He was taken to the third-party defendant (Nassau County Medical Center) for treatment.…
