Appeal by the defendant from a judgment of the Supreme Court, Kings County (Potoker, J.), rendered February 22, 1981, convicting him of murder in the second degree (two counts), assault in the first degree, and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is modified, on the law, by reducing the conviction of assault in the first degree to one of assault in the second degree, and vacating the sentence imposed thereon; as so modified, the judgment is affirmed and the matter is remitted to the Supreme Court, Kings…
