This action was brought by John Warren, an employee of the United Piping Company, against defendant, Johnson & Johnson, under the Structural Work Act (Ill. Rev. Stat. 1971, ch. 48, par. 60 et seq.), for injuries sustained on May 27, 1971 when a ladder on which plaintiff was working allegedly broke or collapsed. Plaintiff’s complaint alleged that defendant, Johnson & Johnson, was “in charge of” the alteration of a certain building in Lemont, Illinois, in which plaintiff was injured and violated the statute by failing to provide a scaffold or a safe ladder.
