¶ 1. Jodell G. seeks leave to appeal from an order of the circuit court denying her motion to dismiss the CHIPS petitions involving her three children as untimely pursuant to WlS. STAT. § 48.24(5) (1997-98). Jodell argues that because the Sheboygan County Department of Health and Human Services intake worker did not request that the CHIPS petitions be filed within forty days of receipt of the referral information, the CHIPS petitions must be dismissed with prejudice pursuant to § 48.24(5). We agree and reverse the order of the circuit court.
