Wetzel, J., at jury trial and sentence), rendered March 28, 2005, convicting defendant of criminal possession of a controlled substance in the fifth degree, and sentencing him as a second felony offender to a determinate term of 21k years in prison and two years of postrelease supervision, unanimously reversed, on the law, the motion to suppress granted and the indictment dismissed.
