after making the foregoing statement, delivered the opinion of the court.
The amended declaration contained two counts. The first charged that the injury was caused in consequence of the defendants having furnished an “ unsafe, unsuitable and defective dolly.” The second count alleges that defendants “ failed to furnish any person to assist said boss carpenter and plaintiff,” and that “ in order to move said timber properly and with reasonable safety along said runway, it was necessary for defendants to furnish for such purpose a number of men, to wit, five men to…
