Appeal from an order of the Supreme Court, Monroe County (John J. Ark, J.), entered January 11, 2013. The order denied the motion of defendant Genesee Valley Group, Ltd. for summary judgment seeking dismissal of the plaintiffs’ claims against it and dismissal of the cross claim asserted by defendant Gary E Lehmann, individually and doing business as Heritage Development Corporation.
It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
