The defendant, a Saudi Arabian national, pleaded guilty to misdemeanor motor vehicle homicide and was sentenced by a judge of the Superior Court (plea judge) to one year in the house of correction followed by two years’ probation. The defendant received probation even though he conveyed to the Commonwealth and the court, at the time of his plea, that he intended to seek permission of the Federal government to “voluntarily depart” the United States at the conclusion of his incarceration.
