This proceeding was instituted before the Albany Special Term of the Supreme Court to compel the respondents, constituting the Board of Regents of the University of the State of New York, to indorse petitioner’s licenses or diplomas permitting him to practice medicine and surgery in the State of New York pursuant to sections 51 and 1259 of the Education Law. The Special Term ordered the proceeding transferred to this court for disposition.

There are no disputed facts. On May 9, 1905, petitioner filed an application with the Education Department for a license to practice medicine in this State.…
