This is a proceeding for the judicial dissolution of a private corporation brought under favor of Sections 8623-86 et seq., General Code, which constitute a part of the General Corporation Act, and comes before the court *420upon the intervening petition of Herman Elsaesser presenting a claim for allowance upon the covenants contained in a lease which he owns as assignee of the lessor and of which the defendant is the assignee of the lessee. Their rights are the same as though they were the original lessor and lessee.
