—In a matrimonial action in which the parties were divorced by judgment entered October 19, 2006, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Prus, J), dated April 22, 2009, as denied, without a hearing, his motion to modify the parties’ stipulation dated June 8, 2006, to award him sole custody of the parties’ child, and his separate motion to modify the stipulation to award him expanded visitation with the child.

Ordered that the order is affirmed insofar as appealed from, without costs or disbursements.
