MEMORANDUM OPINION WITH ORDER ATTACHED

In this motion for judgment of acquittal or, in the alternative, for a new trial, the Court is confronted with two issues, viz.:(1) Whether the Court abused its discretion in excluding evidence of the victim’s 24-year-old conviction for involuntary manslaughter; and(2) Whether the crime of assault with a deadly weapon and the lesser included offense of possession with intent to use a dangerous weapon merge and thereby result in *378defendant being doubly jeopardized by his convictions of both crimes.
