JACKSON, District Judge.

This is a civil action under 35 U.S.C. § 145 in which plaintiff seeks to obtain a patent containing the following claim:

41. The use as a sustained release therapeutic agent in the body of ephedrine adsorbed upon polystyrene sulphonic acid.

In addition to substantively rejecting the claimed subject matter as obvious and unpatentable over the cited prior art, the Patent Office tribunals also formally rejected the claim as indefinite under 35 U.S.C. § 112 and as failing to come within a statutory class „ , , ,. ... ,, , or. of patentable subject matter under 35 rr a n o •,…
