Grice, Justice.

The plaintiff by cross-bill of exceptions complains that the court overruled its motion to strike the special appearance by which the defendant attacked the validity of the service, on the ground that “said plea is defective in that it is a dilatory plea which is not sworn to personally by the defendant, as is required under the laws of this State.” We will not stop to discuss whether the plaintiff properly characterizes as a “dilatory plea” the defendant’s special appearance attacking the validity of the service.
