This is an appeal by defendant from two decrees of the circuit court against him in favor of plaintiff, the first, pronounced November 18, 1904, adjudicating the principles of the canse, and referring the same to a commissioner to state an account between them in accordance therewith; the second, pronounced November -, 1908, overruling defendant’s exception to the commissioner’s report, confirming it, and adjudging that plaintiff recover of defendant the sum of two thousand one hundred and forty-nine dollars and fifty cents, the aggregate of principal, as found by said…
