The instant case arises from the same transaction set out in the companion case of Stemple v. State, Ala.Cr.App.,352 So.2d 33 (1977).

Around 2:00 A.M. on February 5, 1977, Sergeant Gerald Monday, of the Houston County Sheriff's Department, overheard a suspicious conversation between two men on his C.B. (Citizens Band) radio.
