Appeal from a judgment of the County Court of Schenectady County (Tomlinson, J.), rendered October 12, 2001, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.

Defendant was charged with burglary in the third degree after he broke into a convenience store in the City and County of Schenectady, taking cigarettes and cash. He ultimately pleaded guilty to that charge and waived his right to appeal. In accordance with the plea agreement, he was sentenced as a second felony offender to a prison term of 3x/2 to 7 years and was ordered to pay restitution.…
