1Opinion of the Court
The defendant was indicted for murder in the first degree, was tried, and convicted for murder in the second degree, and was given a sentence of 13 years in the penitentiary. The defendant killed his own father, and this fact is admitted. The deceased was shot three times, and some of the evidence for the state tends to show that, after he was shot down, the defendant mauled and beat him in the face and on the head and body with rocks, crushing some of the frontal bones of the face.
