Ferrostaal, an importer and the owner of a shipment of steel coils, appeals from a judgment of the United States District Court for the Southern District of New York (Cedarbaum, J.) in consolidated cargo damage cases brought under the Carriage of Goods By Sea Act (“COGSA”), 46 U.S.C. § 30701 note. Ferrostaal seeks to recover for alleged rust damage and physical damage to steel coils carried on the vessel MTV Tupungato on a voyage from Huachipato, Chile to New Orleans.
