FITZHENRY, Circuit Judge.

Appellee instituted her common-law action to recover damages for the wrongful death of her intestate in the circuit court of St. Clair county, 111. Appellant is a Missouri corporation, while appellee is a citizen of Illinois. Appellant removed the cause to the United States District Court on the ground of diversity of citizenship. After the settlement of the issues, the cause was submitted to a jury, which returned a verdict in favor of appellee, in the sum of $5,000.
