This ease was here once before and a full history of the matter, up to the time it was remanded to the trial court, will be found in United States Building & Loan Assn. v. France et al., 56 Ida. 108, 50 Pac. (2d) 1015. After full consideration of the issues raised, with reference to the validity and application of certain provisions of the statute to the facts of the case, this court said:

“This conclusion, however, does not dispose of the entire controversy because even though the court correctly found that the cheek had been paid and that up to that point the loss would fall upon appellant,…
