This is a suit upon a special tax .bill, issued to the substantial plaintiff Grubaugh by the nominal plaintiff, the city of Marionville, which was at the date hereinafter stated a city of the fourth class. The object of the suit is to enforce a lien on the defendant’s lot for its proportionate liability for the cost of constructing a brick sidewalk on Odell street, on which said lot fronts.'
