This is an appeal from the judgment of the court below, which was entered in the following agreed case: “Whereas, there is a question of difference between the above-named parties which might be made the subject of a civil action; and whereas, the said parties have agreed upon the facts constituting such controversy, and desire to present a submission of the same to the above-entitled court.
