This suit grows out of an automobile accident. Appellee was the owner of a Marmon touring car, ,and in December, 1924, while he was driving his car along the Lexington to Paris road, he undertook to drive around a truck standing in the road, and in doing so he collided with another oar on the road a short distance behind the truck.
