GODDARD, District Judge.

The defendant, 360 East 55th Street Corporation, has demanded a jury trial pursuant to Rule 38 of the Federal Rules of Civil Procedure, 28 U.S.C.A. following section 723c. This demand is opposed by the plaintiffs.

The action is to recover $7,500 damages and $12,500 damages alleged to have been sustained by the plaintiffs, Ernst Van Leyden and Karin Elizabeth Van Leyden respectively, as a result of the negligence of the defendants in allowing water to enter part of the studio building where their property was located.
