Appeal by the defendant from a judgment of the County Court, Nassau County (Boklan, J.), rendered August 6, 1987, convicting him of vehicular manslaughter, vehicular assault, assault in the second degree, criminally negligent homicide and operating a motor vehicle under the influence of alcohol (two counts), upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed, and the matter is remitted to the County Court, Nassau County, for further proceedings pursuant to CPL 460.50 (5).
