MEMORANDUM AND ORDER ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT ON THE COUNTERCLAIM

Plaintiffs entered into an “Open-End Credit Plan” with Defendant bank under which they could borrow up to $80,000.1 Their debt was secured by a mortgage on their home. The procedural history of this case has been discussed at length in prior opinions of the Court. (Docket Nos. 46, 28). Now before the Court is Defendant’s Motion for Summary Judgment on its counterclaim for foreclosure (Docket No. 31), the only claim remaining for adjudication.
