Appeal from a judgment of the Supreme Court (Lawliss, J.), entered July 24, 2012 in Clinton County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 70, without a hearing.
In 1993, petitioner was convicted of a number of crimes, including robbery in the first degree, and was sentenced to an aggregate term of 10 to 20 years in prison. In 2010, he was released to parole supervision, but was thereafter charged with violating the conditions of his parole. He pleaded guilty to one of the violations, his parole was revoked and a 12-month time assessment was imposed…
