VICTOR C. HOWARD, JUDGE
Mark Torbett appeals the Jackson County Circuit Court’s denial of his motion to compel arbitration and dismiss him for lack of personal jurisdiction. He raises three points on appeal complaining that he should be able to enforce the arbitration agreement as a non-signatory because of *834equitable estoppel and agency theory. The judgment is reversed and remanded.
