¶ 1. On November 8, 2012, Casey Mark Burgess was indicted for attempted kidnapping in violation of Mississippi Code Annotated section 97-3-53 (Rev.2014) and aggravated assault in violation of Mississippi Code Annotated section 97—3—7(2)(b) (Supp.2015). On June 18-19, 2013, Burgess was tried and found guilty by a Rankin County jury of both charges. Burgess was sentenced to ten years for attempted kidnapping and twenty years for aggravated assault, to be served in the custody of the Mississippi Department of Corrections (MDOC), with the sentences to run concurrently to…
