OPINION
CORNISH, Judge:
Johnny Clifton Dawson, Sr., was charged and convicted of Murder in the Second Degree in the District Court of Oklahoma County and sentenced to ten (10) years’ imprisonment.
Evidence presented at trial showed that the appellant and the deceased were intoxicated as a result of drinking substantial amounts of beer and whiskey over an extended period of time. During the evening the appellant found a pistol which he tested to see if it would fire. The gun supposedly misfired several times before discharging.
