Appeal from District Court, Ramsey County; Morgan, J. Daniel Maloney, indicted under the name of Thomas Maloney, was convicted of assault with a dangerous weapon, and appeals.

In this action the defendant was charged by indictment with the crime of assault and battery with intent to kill, while armed with a deadly weapon, to-wit, a knife. The indictment was obviously framed under the provisions of section 7115 of the Revised Codes. It was challenged by a motion in arrest of judgment. We think the indictment was sufficient in form and substance, and there can be no doubt of the jurisdiction of the trial court over the subject matter.
