Appeal from an order of the Family Court of Delaware County (Becker, J.), entered April 29, 2009, which dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.
Petitioner (hereinafter the mother) and respondent (hereinafter the father) divorced in 1999 and, in 2002, the mother was awarded legal and physical custody of their two daughters (born in 1993 and 1995).
