1. An old aud infirm father proposed to one of his sons that if the latter would remove from his own home to that of the former, and attend to and take care of him during his lifetime, he would will to the son his home-place. The son accepted this offer, aud according to the evidence, complied faithfully with his part of the contract. Sometime after his removal to his father’s place, the old man became insane, and remained iu that condition until his death, so that it was impossible for him to make the promised will.
